FULL TERMS

These terms apply to the agreement regarding the delivery of products and services, also referred to as goods, to end customers in Europe.

Parties

The seller is: Vitamail AS, Box 138, 1417 Sofiemyr. Phone +47 21 08 01 08, email kundeservice@vitamail.no. Organization number 994450921MVA, and is hereinafter referred to as "Vitamail", "we", or "us".

The buyer is: The person stated as the buyer in the order regardless of the sales channel, and is hereinafter referred to as "you", "your", or "the customer". The person must be 18 years old to become a customer of Vitamail's products.

Subscription

By becoming a customer at Vitamail, you create a continuous subscription. However, the subscription has no fixed term, and there's no mandatory contract period.

If you don't inform us that you want to cancel the subscription within 14 days before the next delivery is sent, you will receive further shipments every other month until you cancel the agreement yourself.

The subscription is ongoing, and you are free to make changes - such as pausing for a certain time, advancing deliveries, or terminating the subscription.

Prices

Our prices are stated in local currency and include VAT. The product price may vary depending on the sales channel, distribution, and special promotions. The prices are valid until they are changed. Notice of price changes is sent well in advance; at least 1 month before the change. Introductory offers cannot be exploited unfairly through frequent and repetitive signing up / cancellation, as it is primarily aimed at new customers. Max 1 introductory offer per customer.

Shipping and handling fees are added to each shipment according to current rates unless otherwise agreed.

Customer Service

Our customer service can be reached at phone +47 21 08 01 08, Monday to Friday between 10:00 am and 4:00 pm. We are also available for questions on our Facebook pages. You can also log in to "my pages" on our webpages for an overview.

Payment

Payment is made via invoice. The invoice is sent along with the delivery to the buyer of the goods. Payment terms are stated on the invoice.

Delivery

We only deliver packages within Europe. Your order arrives in your mailbox 3-11 days after we've received your order. Then you receive new shipments according to the agreed delivery frequency. For special offers, larger or multiple orders, it may be necessary to collect the goods from the post office due to size and weight. If you change your address, you are obliged to update us on the new address.

Personal Information

We process all personal data in accordance with the Personal Data Act. We store and use this information to maintain and manage the customer relationship, including informing about products, services, and other benefits from Vitamail AS. The customer agrees that Vitamail AS can use any form of communication towards you, including letters, phone, email, and SMS, to inform or market our product offer. Right of Withdrawal

As a customer, you are protected by the withdrawal law and have a 14-day unconditional right of withdrawal from the day you receive the goods on your first shipment (also called a sample pack or start pack). The right of withdrawal means you have the right to cancel the purchase of an unopened product and return it to us. For the right of withdrawal to be applicable, the product must be returned to us in the same quantity and condition as when you received it. If you return it, you are responsible for return costs.

Return Right for Subscription Goods

The return right only applies to the first delivery you receive from us (also called a sample pack or start pack). The next goods are identical to the first, so there is no return right for the shipments you receive after the first delivery. We must have information from you at least 14 days before the next delivery is sent (the date of the next delivery is stated on the invoice) if you want to cancel the subscription and so we can stop the delivery.

We do not credit invoices on deliveries that are sent back to us. If you want us to resend it, you will be charged a fee of EUR 10. This is to cover our costs related to handling the return and postage/handling for the new shipment.

Complaints

Full warranty rights are granted in accordance with applicable laws for any deficiencies in the product.

The warranty is limited to the product's expiration date as indicated on the packaging, provided that proper storage has been followed, and a maximum of two months from the date the defect was discovered. In any case, the buyer is obliged to complain within a reasonable time after the error is detected. In the event of a complaint, error, or defect, you will be reimbursed for any shipping costs. If you want to use the warranty or have questions about it, you must contact our customer service.

Conflict Resolution

Complaints should be directed to us within a reasonable time, cf. the section on complaints. The parties shall try to resolve any disputes amicably. If this fails, the buyer can contact the local Consumer Council for mediation.

Choice of Law and Jurisdiction

The agreement is subject to Norwegian law. Disputes between the parties should be resolved through negotiations. If negotiations are unsuccessful, the dispute is referred to the ordinary courts.

Reservations and Limitations of Liability

Vitamail reserves the right to transfer its rights and obligations under this agreement to another party.

Vitamail is not responsible for operational interruptions, incorrect prices, or delivery problems due to circumstances beyond the company's control.

Vitamail further reserves the right to printing errors, price errors, VAT, and other tax changes. Any offers are valid while stocks last.

Vitamail is not responsible for misuse of the product. Follow the recommended dosage.

Change of Terms

The terms are subject to change due to special needs and/or public changes or requirements that affect these terms. If the terms change, you will be notified. Such notice is given up to 1 month before the changes come into effect. If you, based on the changed terms, wish to terminate the agreement, you are free to do so. If the agreement between the parties is not terminated, it implies that you accept the updated terms. New terms will be announced on our website or in combination with the shipment of the goods.
